La Repubblica Napoli reports that the brother realised Apple had failed to trademark its founder's name, Steve Jobs, and decided to make use of the opportunity.

As you'd expect, Apple wasn't best pleased with the name of its founder being used by someone else, so the brothers were hit with a lawsuit.

Apple is known for being in court a lot.

At the time the brothers were launching their own clothing and accessory company after spending years creating products for other brands. Brothers Vincenzo and Giacomo Barbato made a decision to brand their line of clothing and accessories after learning that the name Steve Jobs, Apple's legendary founder, was not actually trademarked.

Of course, Apple sued the brothers over the trademark, targeting their logo with a "J" and a bite taken out of it, which resembled Apple's own logo. That's right, a clothing company out of Italy named Steve Jobs. Their main focus is the stylized letter "J" in the logo that looks like a bite has been taken out if and features an "Apple-esque" leaf. According to Business Insider Italia, Apple focused on the logo and because the J isn't a fruit, the brothers told the outlet, the chunk can not be a bite, as in the Apple logo.

The arguments in court revolved around the use by the brothers of the Apple trademark. It said the brothers should be free to carry on using their trademark.

"We are working on a line of highly innovative electronic devices, projects we have been working on for years", they said in a statement.
We one day could end up having a smartphone with the Steve Jobs name.

It also isn't just the name but the Steve Jobs logo too that has quite some similarity with that of Apple.
