The Dallas Cowboys running back appealed the suspension last week, but National Football League commissioner Roger Goodell's designated arbitrator, Harold Henderson, upheld the suspension in a ruling on Tuesday, ESPN's Chris Mortenson reports. Based on the testimony we heard during Elliott's appeal hearing last week, his ex-girlfriend Tiffany apparently had an affair with Elliott's former teammate Lucky Whitehead.

Elliott's representatives also cited the fact that the NFL's director of investigations, Kia Roberts, did not recommend a suspension for Elliott because she had concerns about his accuser's credibility. Apparently not as Cowboys running back Ezekiel Elliott is appealing a six-game suspension levied by Commissioner Roger Goodell.

If the arbitrator decides in the Elliott's favor, he may be cleared to play in the season opener against bitter division rival New York Giants. The arbitrator didn't meet the deadline to rule on Elliott's suspension, so Elliott can play this Sunday.

Elliott was accused of domestic violence, though charges were never filed.

Dallas finished with the NFC's best record at 13-3 thanks to Elliott and quarterback Dak Prescott, who beat out Elliott for NFL Offensive Rookie of the Year. The NFL shot back with its own court filing Monday night, asking for both the petition to vacate Elliott's suspension and the temporary restraining order the NFLPA requested to be dismissed in order to prevent an injunction so it can enforce Elliott's ban.

Elliott, the N.F.L.'s rushing leader as a rookie last season, was suspended after the league concluded he used physical force last summer in OH against Tiffany Thompson, his girlfriend at the time. Prosecutors in OH didn't pursue the case, citing conflicting evidence.

The NFL believes the NFLPA and Elliott acted improperly by filing their motion before Henderson even announced his ruling on Elliott's appeal. The league's handling of cases involving Ray Rice, Hardy and Peterson in 2014 produced widespread criticism of Goodell and the NFL and led to the personal conduct policy being reworked.

The investigator said Thompson told her that Elliott had become mad that she was dating "some guy" and confirmed that the person was Whitehead. The Southern District of NY falls under the 2nd U.S. Circuit Court of Appeals, which a year ago backed Goodell's four-game suspension of New England quarterback Tom Brady over Deflategate.
