Olivia de Havilland sues FX, Ryan Murphy over Feud portrayal

02 July, 2017, 01:57 | Author: Glenda Knight

Veteran actress Dame Olivia De Havilland is suing FX showrunners for inaccurately portraying her as a gossip-monger.

De Havilland is a two-time Oscar victor - Best Actress for "To Each His Own" (1946) and "The Heiress" (1949) - who is also known for her role in the 1939 classic "Gone with the Wind". She's also upset about a line from the show where Zeta-Jones' De Havilland referred to her sister as a "bitch", which "stands in stark contrast with Olivia de Havilland's reputation for good manners, class, and kindness".

The 101-year-old star has filed a lawsuit claiming showrunners have used her name and identity without permission or compensation, painting her as a "hypocrite, selling gossip in order to promote herself".

Suzelle Smith, an attorney for de Havilland, said in a statement, "A living celebrity has the right to protect her name and identity from unauthorized, false, commercial exploitation under both common law and the specific "right to publicity" statute in California".

"FX defendants did not engage in protected First Amendment speech in putting false words into the mouth of Olivia de Havilland in a fake interview that did not occur and would not have occurred", the statement continues.

The double Oscar-winning actress is famous for having played Melanie Hamilton in Gone With The Wind and Maid Marian in Errol Flynn's Robin Hood. De Havilland, who lives in France, takes issue with the show's reenactment of a purported interview at the 1963 Academy Awards in which she is shown gossiping about the relationship between Davis and Crawford.

A second source close to the administration confirmed the plan and said White House staffers are on board - for now. Acosta also made a tweet with a hashtag asking why the cameras were off.

The star says Feud was created to look like reality, but no one consulted her: the only person alive who experienced the events depicted.

De Havilland's lawyers said they intend to file a motion seeking an expedited trial date because of de Havilland's age.

FX Networks has declined to comment and representatives for Murphy did not immediately respond to the accusations. She also wants an injunction barring TV bosses from continuing to use her name and likeness.

Olivia de Havilland, two-time Best Actress Oscar victor and silver screen icon, is coming out of retirement for one last prize fight.

The "landmark decision" in her legal victory set the outside limit of a studio-player contract at seven years, including suspensions, according to Ephraim Katz's "The Film Encyclopedia".
