ZeniMax have had various lawsuits against the Samsung Gear VR's creators, Oculus, for the same reasons, along with various suits against former members of staff.

Having successfully secured a $500 million payout from Oculus earlier this year, Zenimax is now turning its attention to other companies involved with Oculus.

American media and entertainment company ZeniMax filed a lawsuit against Samsung Electronics, accusing the South Korean tech giant of consciously profiting from the virtual reality (VR) technology made by ZeniMax and misappropriated by Oculus, consequently infringing on a variety of intellectual properties held by the Rockville, Maryland-based firm.

The legal war between Bethesda owner ZeniMax and Oculus has stepped up yet another level.

Carmack owned id Software, a company that was bought by ZeniMax in 2009. ZeniMax is therefore seeking injunctive relief and punitive damages. The proceedings are in infantile stages just yet, but the course of action is well-worth following, as the bill for Samsung may spiral into the hundreds of millions and pose serious considerations for the future of Gear VR. Carmack and Hooper allegedly met in id Software's offices after hours to "talk about Oculus". Zenimax said that Carmack failed to disclose Hooper's presence, and that it only learned of the late night visit through reviewing security camera footage. It also accused Oculus and its founder Palmer Luckey of "commercially exploiting" ZeniMax's computer code and trade secrets to develop its VR products. Samsung did not acquire permission from Zenimax to use its copyrights, similar to what Oculus did in the development of the Oculus Rift.

The company says that Samsung "stands to realize substantial value as a result of its use of ZeniMax's misappropriated intellectual property and information obtained by Samsung from Oculus, Luckey, and Carmack in violation of the NDA and Carmack's employment agreement". That's going to be a tricky situation in court, and ZeniMax is also going to have to prove Samsung was an accessory to Oculus's previous misconduct.
