Prosecution fires back in the Chris Soules case

On Monday, prosecutors in Buchanan County filed documents alleging that Soules bought beer at a convenience store right before he got behind the wheel of his pickup and that he was possibly drinking at the time of the crash, KCRG, the ABC affiliate in Cedar Rapids, Iowa reported.

Soules allegedly purchased the alcohol "shortly before the accident", on a road near his Iowa farm, the filing said. As we previously reported, Mr. Soules is now trying to have the felony charge for the fatal accident he was involved in dismissed as the reality TV vet supposedly did "everything right" following the crash. He has not been charged with drunk driving.

But prosecutors fired back and said Soules tried to evade the law by leaving the scene of the accident so that he couldn't questioned about the partially consumed alcoholic beverages that were found in and around his vehicle.

Authorities say he left the scene after his truck rear-ended a man on a tractor last week.

In the documents, it stated that Soules' level of intoxication could not be determined and the 35-year-old reality star failed to explain the alcohol bottles in his auto.

In court documents for the dismissal obtained by The Register, Soules' legal team alleges the criminal complaint against him is "factually incorrect", insisting "it is indisputable that Mr. Soules has not violated" Iowa Code regarding personal injury crashes.

Soules was booked into the Buchanan County Jail early Tuesday morning on the Class D felony charge of leaving the scene of a deadly accident, but he was reportedly released when his mother Linda Soules posted his $10,000 bond.

Hours after the collision, Soules was arrested at his home.

"The evidence will further show that emergency responders arrived on the scene shortly after Mr. Soules concluded his 911 call". At the time of the motion to dismiss report, Bustle reached out to Soules' lawyers for comment, but did not receive a response.

According to Perezhilton.com, Soules claimed to have handled the tragic event appropriately by remaining with the victim until the EMT's arrived, calling 911 and checking for a pulse. In the filing, he noted that the court had already determined there was probable cause in the case and argued that the defense didn't present any permissible grounds to dismiss the charge under court rules.

Despite that, Soules has a preliminary hearing set for may 9.
